By accessing or using services provided by STARGA, Inc. ("STARGA," "we," "us," or "our"), including the Mind programming language, compiler, runtime, and related tools, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

STARGA provides:

• Mind Programming Language: A systems programming language for AI workloads, including compiler and runtime.
• Mind Cloud: Hosted services for compilation, execution, and monitoring.
• Enterprise Services: On-premises deployment, support, and training.
• Open Source Tools: Apache 2.0 licensed compiler and runtime components.

3. Open Source License

The Mind compiler and core runtime are released under the Apache License 2.0. Your use of these open-source components is governed by the Apache 2.0 license, not these Terms of Service. These terms apply to our hosted services, website, and proprietary features.

4. Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

5. Acceptable Use

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt service integrity

6. Intellectual Property

Except for open-source components, all content, trademarks, and intellectual property on our services are owned by STARGA or its licensors. You retain ownership of any code or content you create using our tools.

7. Payment Terms

For paid services:

• Fees are charged in advance on a subscription basis
• All fees are non-refundable unless otherwise stated
• We reserve the right to modify pricing with 30 days notice
• Failure to pay may result in service suspension

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that services will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

To the maximum extent permitted by law, STARGA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Termination

We may terminate or suspend your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use our services will immediately cease.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
